Arbitration

Like mediation, arbitration is an alternative form of dispute resolution.  We will always discuss alternative forms of dispute resolution with you if it is possible to avoid often costly and time expensive litigation in the courts.
In arbitration, an independent third party acts as the Arbitrator.  The parties make submissions to the Arbitrator who in turn makes a decision based on evidence and the submissions, rather like in the court process. 

Arbitration is different to mediation in that once parties have submitted to the jurisdiction of a trained arbitrator the decision of the arbitrator will be legally binding and enforceable in the courts.  The benefits to clients can be significant. 

Arbitration usually occurs earlier in proceedings therefore saving you and your employees’ time.  Arbitration is also normally cheaper than pursuing a claim all the way to the courts and because of its comparatively informal setting (compared to going before a judge in a court) it may be possible to salvage a working relationships between the parties.
