Mediation

Litigation of a dispute often results in the irretrievable breakdown of the relationship between two parties.  Before the full cost and time commitments of litigation are incurred, it may be possible to resolve commercial disputes via mediation.  We will also always consider mediation with you before Court litigation is commenced.

Mediation involves the intervention of a specially trained neutral mediator.  The mediator’s role is to facilitate a voluntary settlement of a dispute. The Mediator takes no view as to the legal arguments of the parties, but merely tests the strength of their positions.  Mediators usually work on a fixed fee basis (normally split between the parties) and any discussions with the mediator are without prejudice so cannot be referred to in court.  If a negotiated settlement with a mediator is not reached then the parties are entitled to pursue or defend a claim in court.  If the parties do agree a settlement, the agreement becomes binding at that point.
