Discrimination

It is unlawful for an employer to discriminate against a worker in relation to their:

  • Age
  • Religion and belief
  • Disability
  • Sex (male, female or transgender)
  • Race
  • Sexual orientation (gay, lesbian, bisexual or heterosexual)

Discrimination legislation applies in a much broader set of circumstances than, for example, unfair dismissal. Discrimination may occur:

  • Before employment has started (such as in a job interview or in the process used to select an applicant)
  • During employment (in relation to areas such as pay, access to training or unfair treatment)
  • At the termination of employment (such as dismissal for being of a particular race, for being pregnant or for having a disability)
  • After your employment has ended (such as discrimination in a reference given to a new employer)
