Redundancy/Reorganisation

If your employer is proposing to make you redundant, you may have a right to a redundancy payment. In addition, your employer must have a good reason for making you redundant and have followed a proper consultation procedure before doing so.

If your employer has not followed a proper redundancy procedure, does not have proper grounds on which to make you redundant or has selected you for redundancy for an unfair reason (such as your sex or race, the fact you are a trade union representative or because you have asserted rights as a fixed-term or part time employee) you may have a claim for unfair dismissal.

We regularly advise employees on all aspects of the redundancy process right through from when they are first notified of the proposal to make them redundant to any unfair dismissal claim they might bring.
