Expatriate Legal Services
We understand that it can sometimes be challenging for expatriates to find expert, specialist legal advice where they are living at that moment. Going through a relationship breakdown can be distressing enough without the isolation that living in a foreign country brings. If your employer promotes marriage and family values, in particular, you can be left feeling confused and unsure as to where to seek advice and support.
At Mogers we believe that legal excellence should be more than just a “local” thing. If you are an expatriate you need a lawyer with expertise across international jurisdictions. You need us to really understand the subtle and challenging requirements that expatriate clients have and be able to respond to them with the same level as service as if you were just down the road from us.
With clients living in places ranging from Hong Kong to Dubai, Oman and the United States, our client-base is no longer restricted just to the UK.
Why choose Mogers?
Put simply, we have successfully worked in this specialist field for enough years to really understand the common-sense approach that you need. Our experience includes representing the husband in the leading reported case of RP v RP. As members of Resolution, our experts approach each individual matter in a constructive and non-confrontational way, to avoid unnecessary distress to children and prolonging potential conflict between the parties.
Importantly, we don’t only do family law. Are you aware that getting divorced might mean that you have to revise your Will? Will you also have to revise provisions relating to trusts and wealth planning? Do you need help buying or selling property? Perhaps you need advice relating to employment matters (perhaps as a result of relocating after your divorce)? Does your divorce mean that your business is also in need of restructuring?
Whatever your situation, we recognise that you don’t want to have to run around trying to avoid all of the knock-on legal pit-falls of an already traumatic relationship breakdown. We focus on the bigger picture for you and as a result provide the same level of specialist understanding and expertise across the legal disciplines.
In practical terms there are three key areas in which our family law specialists can support you:
- If one party is based in or lives in England or Wales then they will qualify for proceedings to be issued there. We can offer clear and practical advice on how the Courts in this jurisdiction will interpret their circumstances.
-
If you are based in a foreign country we understand that not knowing how your case might or might not be decided, in that country, can be distressing. Whilst we can’t offer advice regarding the law in foreign jurisdictions we can offer advice on possible places to find local, expert knowledge. We can similarly advise on matters where property is retained here in the UK or where the family might return to live in the UK following the separation.
Although, with any relationship breakdown there will be concerns over how to manage the process and actual separation, importantly, we recognise that these are worsened in multi or foreign jurisdiction cases, when there may also be immigration and financial worries over the residence of a spouse or children. The earlier we are able to speak with you about the intricacies of your personal case, the sooner our team of experts can start to resolve these anxieties for you. - When you don’t know what the next step is it can be helpful to discuss all of your options. You may want to discuss whether you are better off divorcing or separating in the UK or abroad. In most cases, we can introduce you to experts local to you who can work with us to provide a complete picture.
