Pre nuptial Agreements
Pre Nuptial agreements are becoming increasingly popular, both with the Courts and with clients.
At the early stages of a relationship few people consider what will happen to their assets and liabilities should the marriage or partnership fail. Many feel uncomfortable in raising financial issues prior to a wedding or civil partnership, but the reality is nowadays many couples bring pre-acquired or family money to the relationship and don't realise that this may not be retained should they separate. Some find the collaborative process an easier way to address financial matters at the outset.
It is therefore increasingly more important to take steps to protect your finances and to put in place the arrangements you would like to see followed should the relationship fail and you go your separate ways. Whilst current law means that pre nuptial agreements will not automatically be enforced the Courts are abiding by them in a growing number of cases and therefore it makes sense to take a few precautionary steps at the outset. In the best case scenario the agreement may never be needed and in the worst case scenario it may save you the emotional and financial drain of contested Court proceedings.
