Freehold Purchases (subject to long leases)

Enfranchisement

Many property owners will not be aware that in certain circumstances there is a legal right for owners of leasehold properties to buy the freehold of the property. This right not only applies to tenants of flats but to owners of leasehold houses. This right is known as a right of Enfranchisement.

Right to Manage

In addition to the above, leaseholders of flats can also collectively exercise a right to force the landlord to transfer his management functions of the building to a special company set up by the leaseholders.

Control of the building can therefore be taken away if the landlord is ineffective, or if the tenants are not happy with the management company chosen by the landlord.

Certain criteria must however be met before either of the above rights can be exercised.
