Purchase Procedure
Take your instructions
Initial correspondence with you, estate agents and Buyer’s Solicitors. Deal with ID requirements
Request Contract papers from Seller’s Solicitors
Apply for searches – Local/Environmental/Coal/Drainage/Chancel
Receive Contract package comprising Contract, evidence of Title, Property Information form, Fixtures, Fittings and Contents form and if Leasehold, Leasehold Property Information form and management information Raise additional enquiries on Contract papers
Receive mortgage offer and check mortgage requirements
Report on search results, additional enquiries and mortgage offer obtain signature to Contract and mortgage documentation Obtain deposit (if no related sale)
EXCHANGE CONTRACTS
Send deposit and Contract to Seller’s Solicitors
Prepare Transfer documentation and raise Requisitions on Title
Prepare final statement of account
Prepare Stamp Duty Land Tax form
Request balance of funds required (if any)
Pre-completion searches and checks at Land Registry and Land Charges Register
Request mortgage funds and balance of funds from you
Obtain signature of Transfer (if required)
COMPLETION
Send balance of monies to Seller’s Solicitors
Submit Stamp Duty Land Tax form and obtain certificate
Attend to Registration at HMLR
Send Deeds to Lender after registration
Advise you of registration and provide copy Register of Title
Matters not covered by our fee: -
1) Obtaining indemnity insurance for defects in title.
2) Preparation of declarations e.g. relating to lack of rights of way and rights to run services through adjoining properties.
3) Dealing with problems relating to title e.g. incorrect boundaries.
